Terms of service

Terms of Service

This English version is provided for convenience only. The German version is legally binding.

§ 1 Scope

These General Terms and Conditions apply to all orders that you place via the online shop of Axel Graupe Metallbauermeister – Axels Aluschmiede, Freckenhorster Str. 73, 48231 Warendorf, Germany (hereinafter "we"). We do not accept deviating terms of the customer unless we expressly agree to their validity.

§ 2 Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order. By clicking the order button at checkout, you submit a binding order for the goods in your shopping cart. Immediately afterwards you will receive an order confirmation by email. The purchase contract is concluded with this order confirmation.

Before submitting your order, you can review your entries at checkout at any time and correct them using the edit links or your browser's back button. You can change items and quantities in the shopping cart.

The contract can be concluded in German or English; the German version of these terms is legally binding. We store the text of the contract. We will send you the order details with the order confirmation by email; you can access and save these terms on this page at any time.

§ 3 Custom-made items

For items with a custom name or custom lettering, we will send you a drawing for approval by email before production. Production only starts after your approval; the stated delivery time begins with the approval. You ensure that the requested text or lettering does not infringe the rights of third parties.

§ 4 Prices and shipping costs

All prices are final prices and include statutory VAT. Any additional shipping costs will be shown to you at checkout before you complete your order.

§ 5 Payment

The available payment methods are shown at checkout. The purchase price is due upon conclusion of the contract.

If you pay in advance by bank transfer, please transfer the purchase price within 7 days of conclusion of the contract to the account stated in the order confirmation. We ship the goods once payment has been received.

If you pay in cash on pickup, you pay the purchase price in cash when collecting the goods from our workshop in Warendorf. This payment method is only available for pickup.

§ 6 Delivery

We deliver within Germany to the delivery address provided at checkout. Alternatively, you can collect your order free of charge from our workshop in Warendorf. Delivery times can be found in our shipping policy.

§ 7 Retention of title

The goods remain our property until full payment has been made.

§ 8 Right of withdrawal

Consumers have a statutory right of withdrawal. Details can be found in our cancellation policy.

§ 9 Warranty

The statutory warranty rights for defects apply unless otherwise stipulated below.

For used goods, the limitation period for claims for defects is one year from delivery of the goods, provided that you have separately and expressly agreed to this on the respective product page by means of a separate checkbox before placing your order. This shortening does not apply to claims for damages due to injury to life, body or health, due to intentional or grossly negligent breach of duty, or in the case of fraudulently concealed defects; in these cases the statutory periods apply.

For surplus stock and used goods, the condition shown in the description and photos (e.g. signs of storage or use, patina, expressly mentioned defects) is deemed the agreed condition, provided that you have separately and expressly agreed to this deviation on the product page before placing your order.

§ 10 Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.
